The Defendant expert witness had previously given evidence in the Employment Tribunal in an employment claim brought by the Claimant against his former employers.  Mrs Justice Lambert considered the case law pertaining to exert witness liability, including the seminal case of Jones v Kaney.  Mrs Justice Lambert also considered the duty on an expert witness to revert to instructing solicitors after a unusual finding and the extent to which medical records need to be checked.
